DOF values are used for property taxation. Condo and co-op tax valuations can differ substantially from sale prices. This is a tax-purpose estimate; comparable sales remain a separate valuation source. Roll exemptions can include STAR under DOF’s published layout.

These values cover the whole tax lot and do not value individual co-op shares.

The calculation deducts $22,095.00 in assessed-value exemptions before applying the tax rate.

How we calculate your annual taxes:
Billable assessed value: $5,744,790.00
minus exemptions: – $22,095.00
times the current tax rate: x 12.4390%
minus abatements and/or STAR: – $111,647.80
Annual property tax: $600,198.24

HOA, common charges and maintenance require documented building or unit evidence. Sales and DOB records do not establish these amounts. A zero property-tax bill does not establish zero PILOT or other ownership charges. Bills may change with tax rates or benefits; monthly figures are annual equivalents.

The Board is not controlled by the Sponsor. Two members of the six member Board of
Directors have been designated by the Sponsor.
Managing Agent
The current managing agent of the Property is First Service Residential - Rego Park, 9525
Queens Blvd., 5th Fl., Rego Park, New York 11374. The managing agent is not affiliated with
the Sponsor.
FinCen’s Geographic Targeting Order
As required by the October 9, 2025 revised Geographic Targeting Order (“Order”) issued
by the Assistant Director of the Financial Crimes Enforcement Network (“FinCen”), United States
title insurance companies are now required to collect and report information regarding purchasers
in transactions where: (1) the purchaser is a legal entity as defined in the Order; (2) the purchaser
purchases residential real property located in the Boroughs of Brooklyn, Queens, Bronx,
Manhattan, and Staten Island; (3) the total purchase price is in the amount of $300,000 or more;
(4) such purchase is made without a bank loan or other similar form of external financing; and (5)
the purchase is made at least in part, using currency or a cashier’s check, a certified check, a
traveler’s check, a personal check, a business check, a money order in any form, a funds transfer
or virtual currency. The affects all residential real property closings beginning October 9, 2025
and ending February 28, 2026 unless further extended.
Financial Condition of the Sponsor
This section is filed pursuant to a New York State Department of Law requirement for all
offering plans for buildings which the sponsor owns more than ten percent of the units.
There has been no material change in the financial position of the Sponsor of the Offering
Plan, which may jeopardize its ability to meet its obligations to the Apartment Corporation.
1. Attached as Exhibit C is a list of the Unsold Shares and the appurtenant
apartments owned by the Sponsor. The Sponsor is the holder of all Unsold Shares.
2. The current aggregate monthly maintenance charges for all apartments owned by
the Sponsor together with all amounts payable by the Sponsor as tenant under the Master Lease
is $55,048.42 each month.

PDF page 3

NY 6300697.2
3. 56 out of a total of 161 apartments are owned by the Sponsor. The current aggregate
monthly rents payable by tenants of apartments owned by the Sponsor together with all amounts
payable to the Sponsor for space covered by the Master Lease is $109,833.00.
4. The Sponsor has no financial obligations to the Apartment Corporation which will
become due within twelve months from the date of this Amendment (other than payment of
maintenance charges and rent under the Master Lease).
5. None of the Unsold Shares are subject to mortgages or financing commitments.
The Sponsor owns all Unsold Shares free of any mortgages, pledges, liens or other
encumbrances.
6. The financial obligations of the Sponsor are funded from the monthly rents paid
by the tenants of the apartments owned by the Sponsor and the monthly rents paid by the tenants
of space covered by the Master Lease. No bond or security has been furnished to secure the
Sponsor's obligations.
7. The Sponsor is current on all financial obligations under the Plan, including, but
not limited to, maintenance charges, taxes, reserve or working capital fund payments,
assessments and payments for repairs or improvements for which the Sponsor was obligated
under the Plan. During the twelve (12) months prior to the filing of this Amendment the
Sponsor has not been delinquent in any of the foregoing obligations. The Sponsor and the
managing agent are discussing whether any amounts are due from the Sponsor for maintenance
on Unsold Units which are subject to the Senior Citizen Rent Increase Exemption and for
amounts due under the Master Lease as a result of the assignment of a portion of the space
under the Master Lease. It is the Sponsor’s position that, despite reference in Note 11 of the
2022 and 2023 financial statements to the Sponsor owing arrears, no amounts are due from the
Sponsor as the managing agent has failed to credit the Sponsor for real estate tax abatements
received by the Apartment Corporation on Unsold Units which were subject to the Senior
Citizen Rent Increase Exemption and further, has billed the Sponsor for Units which were
previously sold. It is the Sponsor’s position that amounts due under the Master Lease were
reduced by an assignment of a portion of the Master Lease, i.e. Professional Apartment A6/A7
and storage space, in 2004 thereby decreasing its percentage of utility charges, insurance, real
estate taxes and mortgage. The Sponsor and the Apartment Corporation are in ongoing
discussions resulting in a reduction in the disputed amount from $93,950 to $56,335.46, which
amount is being held in escrow by attorneys for the Sponsor, Meister Seelig & Schuster PLLC.
8. The Sponsor owns cooperative shares or units in The Capri Apartments, a
cooperative building, and in no other cooperative or condominium building. The only principals
of the Sponsor, as such term is defined in 13 NYCR Section 18.1(c)(2), as an individual holder of
unsold shares or units or as general partner or principal of a sponsor, who own ten percent of the
cooperative shares or units in any other cooperative or condominium building are Laurence Penn,
Carol M. Penn and Valerie A. Penn.

How to read these records

Deed amounts are recorded consideration, not asking prices or a unit valuation. A blank record is not proof that an issue does not exist.
