HOA, common charges and maintenance require documented building or unit evidence. Sales and DOB records do not establish these amounts. A zero property-tax bill does not establish zero PILOT or other ownership charges. Bills may change with tax rates or benefits; monthly figures are annual equivalents.

====================================================================
BELVEDERE VI CONDOMINIUM
216 CALYER STREET
BROOKLYN, NEW YORK 11222
FIFTH AMENDMENT
====================================================================
The Plan for The Belvedere IV Condominium (the “Condominium”) is hereby amended as
follows:
1) Purpose of Amendment. As disclosed in the Second Amendment to the Plan
accepted for filing on July 9, 2007, Belvedere VI LLC (“Original Sponsor”) conveyed its interest
in the substantially completed property to 216 Calyer, LLC (“New Sponsor”) as a successor
sponsor by deed dated September 6, 2007. Title to the first Unit in the Condominium was conveyed
by New Sponsor to the purchaser thereof at a closing held on November 21, 2007, as disclosed in
the Fourth Amendment to the Plan accepted for filing on May 16, 2008. The purpose of this
Amendment is to provide updated disclosures and renew sales at the Condominium.
2) Unsold Units. Annexed hereto as Exhibit A is a schedule of the Unsold Units being
offered for sale by Sponsor as of May 1, 2026, consisting of 1A, 1B, 2A, and 3A. As addressed
below, Unsold Units 2B and 5B are not being offered for sale as of the filing date of this
Amendment. Exhibit A reflects, among other things, the percentage of Common Interest
appertaining to each Unsold Unit, the monthly Common Charges in effect for the current year of
condominium operation, and current real estate taxes. Purchasers are advised to check the DOF
website, available at https://www1.nyc.gov/site/finance/index.page prior to entering into a
Purchase Agreement, for updated information regarding the actual tax obligations assessed against
their particular Unit. As of the date of filing of this Amendment no tax exemption is effective or
contemplated in connection with the Unsold Units. For purposes of this Amendment and in
accordance with New York State Department of Law regulations, an “Unsold Unit” is defined as
a Unit for which a closing has not occurred. With respect to the Unsold Units as of May 1, 2026,
the amount of monthly common charges payable by New Sponsor is $4,143 and the amount of
monthly real estate taxes is $5,945. As of May 1, 2026, none of the Unsold Units are subject to a
lease agreement.
Concerning Unsold Units 2B and 5B, New Sponsor submitted a construction application
plan to the Department of Buildings on April 29, 2026, to restore their mezzanine/storage spaces
to match the condition last depicted on the Floor Plans for the Plan, as included with the Second
Amendment (the “Restoration Work”). It is anticipated, without representation, that the
Restoration Work will be completed and a “Letter of Completion” issued by the Department of
Buildings within approximately 30 days. Upon issuance of a Letter of Completion, New Sponsor
will submit a further amendment to this Plan to offer Unsold Units 2B and 5B for sale. Until such
time as an amendment is accepted for filing by the Department of Law in connection with the offer

of Unsold Units 2B and 5B, no contracts will be entered into, and no deposits will be taken, with
respect to these two Unsold Units.
3) Board of Managers. Under the terms of the By-Laws of the Condominium, the
Board of Managers (“Board”) is to be composed of three individuals, each serving a fixed term of
one year. Notwithstanding that New Sponsor is no longer entitled to control the Board, at the last
special meeting of Unit Owners scheduled to occur on September 25, 2025, the only non-New
Sponsor Unit Owner in attendance declined to serve on the Board. As a result, as of the date of
submission of this Amendment, New Sponsor’s designee, Joseph Fabrizi, is the sole member of
the Board. Mr. Fabrizi has an address at 216 Calyer Street, Brooklyn, New York.
Within 30 days of the next closing of an Unsold Unit, a special meeting of the Unit
Owners will be scheduled to fill the remaining two seats on the Board with Unit Owner
representatives that are not affiliated with New Sponsor, in compliance with the terms of the By-
Laws. The election by Unit Owners of non-New Sponsor affiliated representatives to the Board is
necessary to ensure the continued operation of the Condominium in accordance with the terms of
the Declaration and By-Laws after New Sponsor sells all of the Unsold Units.
4) Budget. A copy of the projected operating budget for the Condominium operating
year ending commencing January 1, 2026 and ending December 31, 2026 is annexed hereto as
Exhibit B. Annexed hereto as Exhibit B-1 is a Certification of Sponsor’s Expert on the adequacy
of the condominium budget, dated March 31, 2026, by Castlewood Property Management LLC.
Castlewood Property Management is a New York limited liability company with an address at 216
Calyer Street, Brooklyn, New York, having experience in the management of condominium,
cooperative and residential rental properties in Connecticut and New York for approximately 10
years.
The principal of New Sponsor is also the principal of Castlewood Property Management
LLC.
5) Audited Financial Statements for the 2022, 2023, 2024 and 2025 Condominium
Operating Years. Annexed hereto as Exhibit C-1, Exhibit C-2, Exhibit C-3 and Exhibit C-4 are
copies of the independent auditor’s report of Cesarano & Khan, Certified Public Accountants
(“Cesarano & Kahn”), setting forth the audited financial statements of the Condominium for
calendar years 2022, 2023 2024 and 2025. As reported in the 2025 audited financial statements, at
the conclusion of fiscal year 2024 and fiscal year 2025, New Sponsor had unpaid obligations to
the Condominium (the “New Sponsor Deficit”) in amount of $100,325.00 and $128,599,
respectively. The New Sponsor Deficit in the total amount of $128,599 will be paid by Sponsor as
set forth in Section 8, below.
6) Description of Property and Specifications of Building Condition; Certificate
of Occupancy. Annexed hereto as Exhibit D is an Addendum to Architect’s Report dated April
30, 2026 prepared by Fischer & Makooi Architects (“Architect’s Report”). The Architect’s Report
provides an update to “Unit Information” and the appliance matrix previously set forth in the Plan.
A permanent certificate of occupancy covering all Units in the Condominium was issued on
August 2, 2007. Annexed hereto as Exhibit D-1 is a Certification of Architect. Annexed hereto as
Exhibit D-2 is the permanent certificate of occupancy.

7) Floor Plans.
a) Annexed hereto as Exhibit E are current Unit Floor Plans and full-floor
Floor Plans for Unsold Units being offered pursuant to this Amendment: 1A, 1B, 2A, and
3A. Purchasers are advised that there are certain variances between the square footages
identified in the Plan and the square footages included in the Declaration of Condominium
and tax lot drawings for the Condominium originally filed with the City Register’s Office,
County of Kings, on October 30, 2007 under CRFN 2007000546212 and 2007000546212,
respectively, which may relate to a different measurement methodology employed by the
original architect under the Plan. In no event will a reduction in square footage exceed 5%
of the total Unit Area. Purchasers will be required to close on their Units notwithstanding
such square footage differences.
b) The following constitute a “Special Risk” of the Plan:
“Accessory Cellar Use for Unsold Units 1A and 1B: Cellar use for Unsold Units 1A and
1B is non-habitable, accessory use only, and may not be used for living or sleeping as
provided under applicable legal requirements.”
“Accessory Mezzanine Use for Unsold Units 2A, 3A and 5A : The mezzanine levels
located in Unsold Units 2A, 3A and 5A are non-habitable, accessory storage only, and may
not be used for living or sleeping as provided under applicable legal requirements.”
8) Lobby Renovation Project. The Condominium is undertaking a lobby renovation
(the “Lobby Renovation Project”), which will include installation of new floor tiles and wall tiles,
new lighting, new exterior glass and repainting of the façade at the lobby entrance, at a total
projected cost of $128,599. In lieu of the Board imposing a special assessment against all Unit
Owners for their pro rata share of the cost of the Lobby Renovation Project, New Sponsor has
agreed to pay for the work at its sole expense, as payment of an equivalent portion of the New
Sponsor Deficit. In addition, on April 27, 2026, New Sponsor made a deposit of $40,000 into the
working capital account of the Condominium, with an account name of “Belvedere VI
Condominium”, A/C# 1501447087, being held at Flagstar Bank, 26 Court Street, Brooklyn, New
York, for use toward working capital, a reserve for repairs or other appropriate purposes as may
be determined by the Board. While New Sponsor controls the Board, the Working Capital will not
be used to reduce Common Charges. As of April 30, 2026, a total balance of $50,406.52 is being
held.
9) Special Assessment for Condominium Reserves. In addition to the $40,000
contribution by New Sponsor described above, the Condominium will be imposing a Special
Assessment in the amount of $60,000.00 in connection with the replenishment of the
Condominium’s reserves, for a total Condominium reserve of $100,000. The Special Assessment
shall be payable by all Unit Owners in accordance with their respective percentage of Common
Interest in monthly installments over three years. Annexed hereto as Exhibit B-2 is schedule of
payments for all of the Units. In connection with the amounts payable with respect to the Unsold
Units owned by New Sponsor, the approximate share of the expense is $44,568.00.
Notwithstanding the foregoing, at or before each closing of an Unsold Unit, New Sponsor will pay

How to read these records

Deed amounts are recorded consideration, not asking prices or a unit valuation. A blank record is not proof that an issue does not exist.
